В этом году правительство Британских Виргинских островов улучшило правовой режим для партнерств с ограниченной ответственностью с принятием нового закона «О партнерствах с ограниченной ответственностью» от 2017 года , а также «Норм для партнерств с ограниченной ответственностью» от 2018 года, которые уже вступили в силу 11 января 2018 года.
Ключевой особенностью нововведений является то, что партнерствам с ограниченной ответственностью с настоящего момента будет позволено иметь правосубъектность, то есть партнерство может иметь договорные обязательства, возбуждать дела или выступать в роли ответчика в судебном производстве от своего имени, а также давать под залог свое имущество, и проводить регистрацию обязательств таким образом, что это будет иметь приоритет над регистрацией обязательств с более поздним сроком или обязательств без регистрации в соответствии с законодательством Британских Виргинских островов.
Новый Закон о партнерствах с ограниченной ответственностью представляет значительный интерес для компаний и частных лиц, которые планируют создание совместных предприятий или создание инвестиционных фондов, поскольку он обеспечивает правосубъектность и гибкость при передаче прав участия или признания новых инвесторов.
